Terms of sale
1. Who we are and when these terms apply
These terms are offered by SiteAfter, a FillFold solution, DE, USA (“we”, “us”). Contact: [email protected]. They apply when you buy a website makeover (the Express makeover or the Complete makeover), including a first website for a business that has none, or the Hosting & care plan. Using the website and asking for a free preview are covered by our terms of use.
Most of our customers buy for their business (a B&B, a guesthouse, a holiday home, an activity or another small business). If you buy as a consumer, that is for purposes outside your trade or profession, section 10 also applies to you, and nothing in these terms reduces your rights as a consumer.
2. The free preview
- A preview is free and commits you to nothing. It is a private, unlisted draft, shown only to you.
- Until you buy, the design and the new texts in the preview remain ours: please do not publish the preview or copy it onto your own site. Your own photos and texts remain yours.
- The extra language in the preview is a draft. If you don’t go ahead, we delete the preview after 30 days at the latest.
3. How you order
- You tell us by email that you want to go ahead, and which plan you choose.
- We email you an order confirmation: the plan, the price, what is included, the languages, when we aim to have your site ready for your review, these terms, and the questions we still need answered (for example your prices and cancellation policy).
- You reply to accept it. The contract is made when we receive your acceptance. If you buy as a consumer, your reply also tells us whether you want us to start work straight away (section 10).
- We confirm the contract by email with the invoice. Work on your live site starts once it is paid.
4. What each makeover includes
Both makeovers include:
- your site rebuilt from the preview you approved, with your own photos and texts, rewritten where needed without inventing facts, and every page proofread; if you had no website, your site is built in the same way from the information and photos you gave us;
- a fast, mobile-friendly site, put live on your own domain (see section 7);
- up to two rounds of changes before the site goes live; further changes are covered by the monthly change of the Hosting & care plan, or quoted separately;
- a link to your existing booking engine, booking page or contact form.
Express makeover, €590: English plus one more language.
Complete makeover, €1,490: English plus three more languages; local search basics (page titles, descriptions, business details in a format search engines read); your Google Business Profile tidied, if you give us access to it; and, if you need one, a booking system set up with you.
Not included: the fees of your booking software, payment provider or domain registrar, which you pay to them directly under their own terms; new photography; new content you have not supplied (for example a page about a service we know nothing about); online shops and other features not described above. We will quote for anything extra before doing it.
5. Translations
- Each language of your live site is translated from your English text and checked by a native speaker before it goes live.
- You choose the languages from those we offer, before work starts.
- Prices, conditions and legal information (for example your cancellation policy or a registration number) are translated as you give them in English. Please check that the English is right: you remain responsible for what your site says.
- When the English text changes later, we update every language of your site in the same way (section 6).
6. The Hosting & care plan, €25 a month
The plan is optional. Without it, we hand you your copy of the site when it is ready (section 7), for you to host elsewhere.
- What it covers: hosting in the European Union with an HTTPS certificate; security updates; backups; up to four seasonal updates a year that you ask for (for example opening dates or seasonal prices); and one change a month, made in every language of your site.
- A change is a small update to existing content: a text, a price, a photo, opening times, a new review. A new page, a new section or a new feature is not a change; we quote for it first. A change you don’t use does not carry over to the next month.
- Billing: the plan starts on the day your site goes live and is invoiced monthly in advance.
- No minimum term. You can stop at any time by email. The plan ends at the end of the month already paid, and you are not charged again. We do not refund part of a month, except where section 10 gives you that right or where we did not provide the service as agreed.
- When you stop, we send you a full copy of your site (section 7) before the end of the paid month, and keep it online until then.
- Price changes: we give you at least 30 days’ notice by email of any change in the monthly price. If you don’t accept it, you can stop before the new price applies.
- Availability: we aim to keep your site online at all times, but we cannot promise it will never be unavailable, for example during maintenance or a fault of our hosting provider.
7. Your site, your domain and your copy
- Your domain stays yours. It remains registered in your name. If you don’t have one, we help you register it in your name; we never register a customer’s domain in ours.
- Your content stays yours. You keep all rights in your photos, logo and texts. You allow us to use them to build, host and update your site, and for nothing else.
- The site is yours once paid. When the makeover is paid in full, you own the design and texts we created for your site. The code and templates behind it are tools we reuse for all our customers; we give you a permanent, free licence to use, copy and change them for your site, with or without us.
- Your copy. At any time after payment, and whenever you stop the monthly plan, we send you on request a full copy of your site (its files, texts in every language and images) within 10 working days, so that anyone can host it. Forms that rely on our servers will then need a form service of your new host.
- Showing your site as an example. We ask your permission first, and you can withdraw it at any time.
8. Prices and payment
- Prices are in euro. The price on your order confirmation is the total price you pay.
- Makeover invoices are paid in full before work on your live site starts. Monthly invoices are payable on receipt. You pay by bank transfer to the account shown on the invoice; card payment will be offered when online payment opens.
- If a monthly invoice is still unpaid 14 days after a reminder, we may take your site offline until it is paid. We then keep your site for 30 days, and send you your copy on request.
9. Your part
- Give us accurate information (prices, availability, conditions, registration or approval numbers) and answer our questions so that we can finish your site.
- Only give us photos, logos and texts you have the right to use.
- Check your site before it goes live and tell us of any error you notice.
- Keep your own legal obligations as a business: for example your own privacy notice towards your guests or customers, your terms and conditions, and any registration your activity requires.
If we are waiting for you for more than 60 days during a makeover, we may put your site live with what we have, after warning you by email, or close the order. If we close it, we keep only the price of the work done, in proportion to the full price, and refund the rest.
10. If you buy as a consumer: your right to cancel
If you buy as a consumer at a distance (by email, for example), you can cancel the contract within 14 days of the day it was made, without giving any reason (Consumer Rights Act 2022, sections 112 and 113). This applies to a makeover and to the Hosting & care plan. To cancel, tell us clearly by email at [email protected] before the 14 days end.
- If we have not started: we refund everything you paid within 14 days of your cancellation, by bank transfer to the account you paid from, at no cost to you.
- If you asked us to start straight away: we only start work during the 14 days if you ask us to, in writing (your reply accepting the order), and confirm that you know you will lose your right to cancel once the work is fully done. If you then cancel during the 14 days, you pay for the work done up to the day you tell us, in proportion to the full price, and we refund the rest (section 119).
- Once the work is fully done with your prior express consent, before the 14 days end, you can no longer cancel (section 111(a)).
You can use the model cancellation form below, or any other clear statement. We send it to you with your order confirmation.
To SiteAfter, a FillFold solution, DE, USA, [email protected]:
I/We (*) hereby give notice that I/We (*) cancel my/our (*) contract for the supply of the following service (*):
Ordered on (*) / received on (*):
Name of consumer(s):
Address of consumer(s):
Signature of consumer(s) (only if this form is notified on paper):
Date:(*) Delete as appropriate.
This does not affect your other rights as a consumer, including your right to a service supplied with reasonable care and skill and as described.
11. If something is wrong
If your site does not work as it should, or does not match what we agreed, tell us at [email protected]. We fix errors on our side free of charge, at any time while you have the Hosting & care plan and for 30 days after a makeover goes live otherwise. This does not limit your rights under the Consumer Rights Act 2022.
12. Data we process for you
If your site has a contact or booking form hosted by us, we receive your guests’ or customers’ messages on your behalf. For that data you are the controller and we are your processor. The data concerned is the name, contact details and message of the people who use those forms, for as long as we host your site. We:
- use it only to run your site and pass messages on to you, following your instructions, and for nothing else; our team may access it from the United States, protected by the safeguards described in our privacy notice;
- tell you immediately if we think an instruction breaks data protection law;
- ensure that the people who handle it are bound by confidentiality, and protect it with appropriate security measures;
- use only the subprocessors listed in our privacy notice (hosting, email delivery), under the same obligations, and tell you before adding or replacing one so that you can object; we remain fully liable to you for them;
- help you answer requests from people exercising their rights, and with security, breach notification, impact assessments and prior consultation (GDPR Articles 32 to 36); we tell you without undue delay of any personal data breach;
- when our service ends, delete or return the data, at your choice, and delete remaining copies, unless the law requires us to keep them;
- give you the information you need to show that these obligations are met, and allow audits on reasonable notice.
Booking engines and payment providers you use on your site process data under their own terms with you, not through us.
13. Our liability
We take reasonable care in building and hosting your site. If you buy for your business, and to the extent the law allows, our total liability under a contract is limited to the higher of the makeover price and the amounts you paid us under it in the 12 months before the event, and we are not liable for lost bookings, revenue or profit, for the services of your booking engine, payment provider or domain registrar, or for errors in information you gave us. Nothing in these terms limits liability that cannot be limited under Irish law, or your statutory rights as a consumer; this limit does not apply to consumers.
14. Changes, law and complaints
We may update these terms for a valid reason, such as a change in the law or in our services. The version that applies to a makeover is the one you accepted with your order. For the monthly plan, we give you 30 days’ notice of any change that is not in your favour, and you can stop before it applies. These terms are governed by the law of Ireland, and the courts of Ireland have jurisdiction, without depriving a consumer of the protection of the law of the country where they live; a consumer may also bring proceedings in the courts where they live. If you are unhappy with our service, write to [email protected]: we acknowledge every complaint within 5 working days and reply in full within 30 days. We do not take part in an out-of-court dispute resolution scheme.
